HCBS Statewide Transition Compliance


In accordance with the home and community-based services (HCBS) final rule regulations outlined in 42 CFR 441.301(c)(4)(i), the South Carolina HCBS Statewide Transition Plan will be submitted for final approval by the Centers for Medicare and Medicaid Services (CMS) no later than spring of 2019. Upon final approval of the South Carolina HCBS Statewide Transition Plan and in compliance with the requirements of the HCBS regulation, the South Carolina Department of Health and Human Services (SCDHHS) will require all HCBS providers to ensure that Medicaid beneficiaries receive the same services and access to the greater community as those who are not Medicaid beneficiaries. This will be monitored through regular, ongoing compliance reviews of HCBS providers. This supports the objectives of the HCBS regulation and builds on long-standing federal nondiscrimination laws such as Title VI of the Civil Rights Act of 1964, Section 504 of the Rehabilitation Act of 1973 and the Americans with Disabilities Act of 1990.
